Madam:

 

     Your Committee on Water and Land, to which was referred H.B. No. 3175, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO COMMERCIAL MARINE FISHING REPORTS,"

 

begs leave to report as follows:

 

     The purpose of this measure is to amend the title of section 189-3, Hawaii Revised Statutes, to more accurately reflect the need for flexibility in commercial marine fishing reporting requirements.

 

     Testimony in support of this measure was submitted by the Department of Land and Natural Resources, The Nature Conservancy of Hawaii, and one interested individual.

 

     Your Committee finds that it is beneficial to bring state requirements regarding commercial fishing reporting into compliance with federal regulations in fishery areas under the joint jurisdiction of the state and federal governments.

 

     Your Committee has amended this measure by adding a new section within chapter 189, Hawaii Revised Statutes, which would require that in fishery areas under joint state and federal jurisdiction, that the Department of Land and Natural Resources shall adopt rules necessary to effectuate the federal requirements.

 

     As affirmed by the record of votes of the members of your Committee on Water and Land that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 3175, H.D. 1, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 3175, H.D. 1, S.D. 1, and be placed on the calendar for Third Reading.
