SENATE CONCURRENT

RESOLUTION

 

 

requesting the Aquatic Resources Division of the Department of Land and Natural Resources to begin a rulemaking process, pursuant to section 187A-5, Hawaii Revised Statutes, to amend the administrative rules, as necessary, to resolve the user conflictS between commercial akule fishermen and recreational pole fishing in various harbors on Kauai.

 

 


     WHEREAS, there has been and continues to be user conflict between commercial akule fishermen and recreational pole fishing in various harbors on Kauai, including Port Allen and Nawiliwili; and

 

     WHEREAS, there have been allegations that the commercial akule fishermen have been depleting fish stocks to the detriment of recreational pole fishing in these areas; and

 

     WHEREAS, in other harbors statewide comparable situations have been addressed through legislation and administrative rules; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2008, the House of Representatives concurring, that the Aquatic Resources Division of the Department of Land and Natural Resources (Department) is requested to begin a rulemaking process, pursuant to section 187A-5, Hawaii Revised Statutes, to review the current status of the user conflict between commercial akule fishermen and recreational pole fishing in various harbors on Kauai, to hold public meetings, and to recommend rule changes that would better balance the use conflicts between the two parties; and

 

     BE IT FURTHER RESOLVED that the rulemaking process is requested to begin as soon as possible and that the Department is requested to report to the Legislature no later than twenty days prior to the convening of the Regular Session of 2009, on the status of the adoption of any relevant rules; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources.
