A BILL FOR AN ACT


 

 

relating to liability for coqui frog eradication efforts.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 141, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§141-    Limited immunity; coqui frog eradication; volunteers.  (a)  No governmental agency or private entity shall be liable for injury or damages sustained by unpaid volunteers who voluntarily assist in coqui frog eradication programs or projects; provided that this immunity from liability shall not apply to governmental agencies or private entities in cases of gross negligence or wanton acts or omissions.

     (b)  For purposes of this section:

     "Agency" means a department, agency, board, commission, council, task force, committee, or other political subdivision of a county or the State that administers, manages, or otherwise engages in coqui frog eradication programs or projects.

     "Entity" means an individual, company, corporation, partnership, or other legal entity that administers, manages, or otherwise engages in coqui frog eradication programs or projects."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
