HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING THE AUDITOR TO PERFORM A STUDY TO DETERMINE WHETHER model photographers SHOULD BE LICENSED BY THE Director OF COMMERCE AND CONSUMER AFFAIRS.

 

 

 


     WHEREAS, H.B. No. 2400, introduced during the Regular Session of 2008, proposes to require licensure for persons who hold themselves out to the public as professional model photographers; and

 

     WHEREAS, professional model photographers need technical expertise, creativity, and the appropriate professional equipment in order to create commercial-quality photographs; and

 

     WHEREAS, model photographers are engaged in making and selling the photographs of individuals for profit; and

 

     WHEREAS, model photographers need to help people relax in front of the camera; and

 

     WHEREAS, model photographers must have knowledge of licensing and copyright laws, as well as knowledge of contracts and negotiation procedures; and

 

WHEREAS, photographers need to follow the laws regarding privacy, and property and personal rights; and

 

     WHEREAS, section 26H-6, Hawaii Revised Statutes, requires that new regulatory measures being considered for enactment that, if enacted, would subject unregulated professions and vocations to licensing shall be referred to the Auditor for analysis; and

 

     WHEREAS, section 26H-6 further requires that referral shall be by concurrent resolution that identifies a specific legislative bill to be analyzed; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2008, the Senate concurring, that the Auditor is respectfully requested to perform a study to determine whether professional model photographers should be licensed by the Director of Commerce and Consumer Affairs; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to submit to the Legislature a report on its findings and recommendations, including proposed legislation, not later than twenty days prior to the convening of the Regular Session of 2009; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and Director of Commerce and Consumer Affairs.
