A BILL FOR AN ACT

 

 

relating to invasive species.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  According to the department of land and natural resources alien species have caused substantial damage to Hawaii's environment, economy, natural resources, and native ecosystem.

     Hawaii has the highest rate of extinction of its native species within the United States and has one of the highest rates of extinction to its native species within the entire world.

     The purpose of this Act is to appropriate funds to be granted to organizations whose purpose is the eradication of invasive species, the prevention of the spreading of invasive species, and the protection of native species.

     SECTION 2.  Section 150A-4.5, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The moneys in the pest inspection, quarantine, and eradication fund shall be expended by the department for [the]:

     (1)  The operation of pest inspection, quarantine, eradication, [and] monitoring programs, and related facilities[, and the];

     (2)  [and] The execution of emergency remedial measures when pests are detected in the course of inspection and quarantine activities by the department[.]; and

     (3)  The issuance of grants to organizations for the purpose of eradicating invasive species, preventing the spread of invasive species, or protecting native species."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2008-2009 for deposit into the pest inspection, quarantine, and eradication fund.

     SECTION 4.  There is appropriated out of the pest inspection, quarantine, and eradication fund the sum of $           or so much thereof as may be necessary for fiscal year 2008-2009 for the issuance of grants in accordance with section 150A-4.5(b)(3), Hawaii Revised Statutes.

     The sum appropriated shall be expended by the department of agriculture for the purposes of this Act.

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect on July 1, 2008.
