A BILL FOR AN ACT


 

 

RELATING TO WATER.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Kaelepulu pond in the community of Enchanted Lake on the windward side of Oahu is a natural estuary that was formerly part of a native Hawaiian fishpond.  Kaelepulu pond supports abundant marine fish populations and provides a breeding habitat for at least three species of endangered Hawaiian waterfowl.

     However, Kaelepulu pond is on the department of health's list of impaired waters:  the pond and Kailua's canals receive runoff from storm drains and sediments as part of the federal National Pollutant Discharge Elimination System permitting program, but the runoff and sediments deposited into these bodies of water have contributed to significant shallowing of the waters.

     To exacerbate the problem, Kaelepulu pond and Kawai Nui stream empty into Kaelepulu stream, which enters the state waters of Kailua bay across a state beach and through a popular city and county of Honolulu beach park.

     Therefore, the purpose of this Act is to appropriate funds to dredge and install drain inlets, sediment devices, and other modifications in Kaelepulu pond.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $1,325,000 or so much thereof as may be necessary for fiscal year 2007-2008 for:

     (1)  Design                  $25,000;

     (2)  Construction            $800,000;

     (3)  Equipment               $500,000,

to dredge and install drain inlets, sediment devices, and other modifications in Kaelepulu pond in Kailua, Oahu.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2007.
