A BILL FOR AN ACT


 

 

making an appropriation for improvements at and the relocation of honolulu marine, inc. to keehi small boat harbor.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1. (a)  Honolulu Marine, Inc., currently operates a commercial marine railed ship repair facility on public lands at Kewalo basin under the jurisdiction of the Hawaii community development authority.  The ship repair facility is one of very few in the entire state and is very important to the boating and fishing industry in Hawaii.  The land that the ship repair facility occupies is subject to a lease with a term extending to 2021.  However, the Hawaii community development authority is actively seeking to have Kewalo basin and the surrounding fast land area, including the leased premises to Honolulu Marine, Inc., developed by a private developer through a request for proposals process. 

     It is in the interest of the state that the Kewalo basin lands be developed as soon as possible.  The Hawaii community development authority, department of transportation, and department of land and natural resources are all working with Honolulu Marine, Inc., to relocate the ship repair facility, and a location has been identified on public lands controlled by the department of land and natural resources next to the Keehi small boat harbor, comprising fifty thousand, four hundred square feet.  All the parties, including Honolulu Marine, Inc., are in agreement that the ship repair facility should be relocated to the Keehi location; however, Honolulu Marine, Inc., does not have the financial capacity to make the necessary improvements for the relocation.

     These improvements include:

     (1)  The installation of port security infrastructure surrounding the entire boundary of the parcel;

     (2)  Grading and leveling the parcel;

     (3)  Construction of a finger pier; and

     (4)  Construction of a sea wall and bulk heads.

     (b)  The purpose of this Act is to make an appropriation, allowing the department of land and natural resources to:

     (1)  Make improvements to the Keehi parcel, in accordance with the recommendations and specifications of Honolulu Marine, Inc.;

     (2)  Assist Honolulu Marine, Inc., in relocating from Kewalo basin to Keehi small boat harbor; and

     (3)  Enter into a long-term lease with Honolulu Marine, Inc., that provides for a reasonable rent, plus provisions for the repayment over time of the amounts expended by the department of land and natural resources for the improvements and relocation.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $    or so much thereof as may be necessary for fiscal year 2007-2008 for:

(1)  Improvements to be made on public lands at Keehi small boat harbor;

(2)  The relocation of the Honolulu Marine, Inc., ship repair facility from Kewalo basin to the improved public lands at Keehi small boat harbor; and

(3)  Entering into a long-term lease with Honolulu Marine, Inc., that provides for reasonable rent, plus provisions for the repayment over time of the amount expended by the department of land and natural resources for the improvements and relocation.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2050.
