A BILL FOR AN ACT


 

 

relating to hazardous land.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-    Hazardous land areas.  (a)  Each county shall inventory all lands that are within the urban district or conservation district or subject to a petition to put the land in the urban district to determine whether any of these lands within the county are hazardous land areas.  For purposes of this section, "hazardous land areas" shall include areas in urban use or potential urban use that are susceptible to rock or land slides that could cause serious injury or property damage.

     (b)  Each county shall adopt standards for urban development in hazardous land areas, including but not limited to:

     (1)  The prohibition of certain land uses and activities that are permitted in a hazardous land area;

     (2)  The establishment of necessary buffer zones for permitted uses or existing uses within hazardous land areas;

     (3)  Special building standards and requirements for all structures in hazardous land areas; and

     (4)  The need for reinforced barriers, screening, or other measures to prevent rock or land slides in already developed hazardous land areas.

     (c)  Each county shall enact zoning, subdivision, and building ordinances to implement the hazardous land areas standards it develops pursuant to this section."

     SECTION 2.  Each county shall inventory its land and adopt ordinances in accordance with this Act within one year of the effective date of this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2007.
