A BILL FOR AN ACT

 

 

PROPOSING AN AMENDMENT TO ARTICLE XVI, SECTION 2, OF THE HAWAII CONSTITUTION TO PROVIDE FOR FORFEITURE OF RETIREMENT BENEFITS OF A MEMBER OF THE EMPLOYEES' RETIREMENT SYSTEM WHO IS CONVICTED OF A FELONY FOR CONDUCT RELATED TO THE EMPLOYEE'S DUTIES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to propose an amendment to article XVI, section 2, of the Constitution of the State of Hawaii to provide for forfeiture of retirement benefits for members of the employees' retirement system who are convicted of a felony.

     SECTION 2.  Article XVI, section 2, of the Constitution of the State of Hawaii is amended to read as follows:

     "EMPLOYEES' RETIREMENT SYSTEM

     Section 2.  Membership in any employees' retirement system of the State or any political subdivision thereof shall be a contractual relationship, the accrued benefits of which shall not be diminished or impaired[.], except that forfeiture of such benefits may be as provided by law for conviction of a felony for conduct related to an employee's or elected official's duties."

    SECTION 3.  The question to be printed on the ballot shall be as follows:

    "Shall the retirement benefits of a public employee of the state or county be forfeited for conviction of a felony for conduct related to the duties of the employee, as may be provided by law?"

     SECTION 4.  Constitutional material to be repealed is bracketed and stricken.  New constitutional material is underscored.

     SECTION 5.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
