A BILL FOR AN ACT

 

 

RELATING TO HIGHWAYS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 264-18, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  Out of the state highway fund reasonable amounts shall be expended as necessary by the State for the establishment of bikeways.  Bikeways shall be established[, whenever practicable,] wherever a new or existing highway, road, or street is being constructed, designed, planned, reconstructed, relocated, or rehabilitated.  Plans for any mass transit system shall include safe, dedicated bikeways and may include a requirement that bicycle racks be installed and utilized on mass transportation vehicles to enable riders to connect conveniently between bus stops and transit stations.  This subsection shall not be construed as requiring the expenditure of a county surcharge on state tax under section 46-16.8, on bicycle paths when the application of this subsection would be in conflict with section 46-16.8."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
