HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING THE DEPARTMENT OF PUBLIC SAFETY TO report to the legislature on THE FINANCIAL REQUIREMENTS of transPORTING, housing, and any other costs associated with the operations and administration of sending hawaii inmates to out-of-state correctional facilities.

 

 

 


     WHEREAS, the State of Hawaii, which began sending its inmates to out-of-state correctional facilities in 1995, beginning with three hundred inmates, has since continued the practice; and

 

     WHEREAS, Hawaii inmates have been transferred to Texas, Minnesota, Arizona, Oklahoma, Mississippi, Tennessee, Colorado, and Kentucky, at varying costs to the State of Hawaii per inmate, per day; and

 

     WHEREAS, as of December 2006, the Department of Public Safety maintained a total of 1,872 male and female inmates in four states other than Hawaii, specifically at:  Diamondback Correctional Facility in Oklahoma, Florence Correctional Center in Arizona, Tallahatchie County Correctional Facility in Mississippi, and Otter Creek Correctional Center in Kentucky; and

 

     WHEREAS, according to the Department of Public Safety, expenditures for fiscal year 2005-2006 for out-of-state inmates in Oklahoma, Mississippi, Arizona, and Kentucky totaled $41,741,214.61; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2007, the Senate concurring, that the Department of Public Safety is requested to report to the Legislature on the financial requirements of transporting, housing, and any other costs associated with the operations and administration of sending Hawaii inmates to out-of-state correctional facilities; and

 

     BE IT FURTHER RESOLVED that the Department of Public Safety is requested to include in its report, but not be limited to, the following:

 

(1)  A breakdown of expenditures of basic daily costs per inmate, per facility;

 

(2)  An assessment of the department's ability to plan, implement, and expend funds on a timely basis;

 

(3)  An analysis of the written agreements with private contractors to include the cost of basic services and programs provided, along with a breakdown of costs that exceed basic services and programs;

 

(4)  A summary of revenue sources, including other governmental matching funds or grants;

 

(5)  A breakdown of expenditures since fiscal year 2002-2003 to present, and projected future expenditures, of air and ground transportation of inmates to and from Hawaii, and transportation of inmates to and from medical services;

 

(6)  A breakdown of other personnel costs such as overtime; and

 

(7)  A breakdown of cost of optional services offered to inmates; and

 

     BE IT FURTHER RESOLVED that the Department of Public Safety is requested to include data from fiscal year 2002-2003 to the present and may include data, information, or conclusions reported by task forces that have convened in the past or agencies that have evaluated the financial expenditures and revenues of the department; and

 

     BE IT FURTHER RESOLVED that the Department of Public Safety is requested to submit a report of its findings to the Legislature no later than thirty days prior to the convening of the Regular Session of 2008; and

 

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor and the Director of Public Safety.
