A BILL FOR AN ACT


 

 

relating to cultural impact studies.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 6E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§6E-    Comprehensive cultural impact study.  The state historic preservation division shall require a comprehensive cultural impact study to be conducted whenever an environmental impact statement is required for a proposed land development in the State pursuant to section 343-5.  The cultural impact study shall carry out the purpose of this chapter to recognize, conserve, and develop the historic and cultural heritage of the State as an important asset for the enrichment of all of the State's residents."

     SECTION 2.  This Act shall not apply to any development for which an application for a building permit was filed prior to its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2007.
