A BILL FOR AN ACT


 

 

making an appropriation for erosion control measures along kawa stream in kaneohe, oahu.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Recent rains and flooding in the State have caused major damage to property and created threats to public safety.  Historically, erosion has posed a problem along Kawa stream in the Pikoiloa tract of Kaneohe.

     Some portions of the banks of Kawa stream have concrete lining to prevent erosion.  Other sections of the stream, however, have no concrete lining or have concrete lining that is in need of repair.  Erosion of the Kawa stream bank threatens the public health and the safety of residents and their properties along the stream.

     The legislature believes that proactive measures are prudent and should be taken to prevent damage to private property and potential harm and danger to residents in areas that are prone to erosion and flooding.  Furthermore, the legislature finds it in the public interest that government funds be appropriated to address erosion concerns along Kawa stream.

     The purpose of this Act is to appropriate funds for the complete construction, restoration, and repair of the Kawa stream bank to prevent further erosion. 

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $       , or so much thereof as may be necessary for fiscal year 2007-2008, for plans, design, and construction to restore and repair the Kawa stream bank in Kaneohe, Hawaii, and to prevent further erosion in the future.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2007.
