A BILL FOR AN ACT


 

 

relating to transportation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that mopeds and their riders are not subject to the same regulation as automobiles or motorcycles and their drivers.

     The legislature finds that parking for mopeds is limited, especially in urban areas, and parked mopeds often obstruct all or part of pedestrian sidewalks adjacent to moped parking areas.

     The legislature finds that mopeds are often modified illegally by removing speed governors, altering exhaust systems, or repairs omitted to maintain their compliance with the law.

     The legislature also finds that because of their relatively small size, mopeds are easily stolen and used by drug dealers to get away from police by navigating through narrow areas or abandoned easily.

SECTION 2.    The state highway safety council shall create a moped safety task force.  The task force shall be chaired by the Director of Transportation or the Director's designee and consist of the following members:

     (1)  The Chief of Police and Director of Finance, or other official responsible for motor vehicle licensing and registration from a local government;

     (2)  One representative of the moped sales industry, to be appointed by the Governor;

     (3)  One representative of the moped rental industry, to be appointed by the Governor;

     (4)  One member of the Senate, to be appointed by the Senate President; and

     (5)  One member of the House of Representatives, to be appointed by the Speaker of the House of Representatives.

     The moped safety task force shall determine how the advantages of the mopeds can be maximized, the disadvantages minimized, necessary legislation, and report its findings to the Legislature not later than twenty days prior to the convening of the Regular Session.

     SECTION 3.  This Act shall take effect upon its approval.
