A BILL FOR AN ACT


 

 

relating to hawaiian home lands.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  There is established a Hawaiian homestead community self-governance task force within the department of Hawaiian home lands for administrative purposes only.  The task force shall begin the process of implementing the provisions of section 201.6 of the Hawaiian Homes Commission Act, 1920, relating to community-based governance on Hawaiian home lands.  The task force shall be composed of the following members or their respective designees:

     (1)  The chairperson of the Hawaiian homes commission of the department of Hawaiian home lands;

     (2)  The chairperson of the State Council of Hawaiian Homestead Associations;

     (3)  A member designated by and representing each Hawaiian Homestead ahupua'a on Kauai, Oahu, Molokai, Maui, Lanai, and Hawaii;

     (4)  A member designated by and representing Hui Kakoo Aina Ho'opulapula;

     (5)  The president of the Council for Native Hawaiian Advancement;

     (6)  The chairperson of the Office of Hawaiian Affairs; and

     (7)  The chairperson of the Association of Hawaiian Civic Clubs.

A majority of the task force members shall select a chairperson from among the members.  Task force members shall serve without compensation but shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.

     (b)  The task force shall review the steps necessary for the State, subject to the consent of the Congress of the United States, to delegate to a democratically-elected Hawaiian homestead community self-governance organization, authority relating to the administration of the Hawaiian Homes Commission Act, 1920, pursuant to section 201.6 of the Hawaiian Homes Commission Act, 1920.  The study shall identify:

     (1)  The administrative powers and responsibilities that the Hawaiian homes commission may consider delegating to a democratically-elected Hawaiian homestead community self-governance organization, including the governmental services that the organization may be empowered to perform for its homestead community;

     (2)  Criteria that may be used to determine the boundaries and location of a Hawaiian homestead community;

     (3)  Criteria that may be used to determine whether a Hawaiian homestead community self-governance organization is eligible for delegation of Hawaiian homes commission administrative authority;

     (4)  Methods or procedures by which a Hawaiian homestead community may establish a Hawaiian homestead community self-governance organization that meets the criteria for delegation of Hawaiian homes commission administrative authority;

     (5)  Contractual requirements necessary to ensure that any governmental service to be performed by a Hawaiian homestead community self-governance organization by contract with the Hawaiian homes commission will be performed at a level and quality comparable to the services that would otherwise be provided by the department of Hawaiian home lands;

     (6)  Any implementing rules the department of Hawaiian home lands should adopt in accordance with chapter 91; and

     (7)  Any other guidelines or other matters that would facilitate implementation of section 201.6 of the Hawaiian Homes Commission Act, 1920.

     (c)  The task force shall submit its findings and recommendations to the legislature, including any proposed legislation, no later than twenty days prior to the convening of the regular session of 2008.

     (d)  The task force shall cease to exist on June 30, 2008.

     SECTION 2.  There is appropriated out of the native Hawaiian rehabilitation fund established under section 213 of the Hawaiian Homes Commission Act, 1920, the sum of $     or so much thereof as may be necessary for fiscal year 2007-2008 for the operations of the Hawaiian homestead community self-governance task force.

     The sum appropriated shall be expended by the department of Hawaiian home lands for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2050.
