RELATING TO THE CHILD PROTECTIVE ACT.

Protects child from being removed from a guardianship if parent cannot show substantial change in circumstances. Allows parent the opportunity to file for dissolution of a guardianship if it is shown that a safe home can be provided.

RELATING TO CHILDREN.

Prohibits leaving a child under the age of 8 locked in a car or building while the person responsible for the child is absent, unless a reliable person at least 13 years old remains with the child.

RELATING TO CHILD SUPPORT ENFORCEMENT.

Clarifies that information maintained by the CSEA may be disclosed to persons who are directly involved with the administration and implementation of a program approved by Title IV-E of the Social Security Act.

RELATING TO CHILD ABUSE OR NEGLECT REPORTING.

Requires staff members of public or private schools, agency, or institutions who, in their professional capacity, have reason to believe that child abuse or neglect has occurred, or that there exists a substantial risk that a child may be abused or neglected in the foreseeable future, to immediately report the abuse or neglect directly to the DHS.

RELATING TO CRIMINAL HISTORY RECORD CHECKS FOR SERVICE PROVIDERS OF THE OFFICE OF YOUTH SERVICES.

Authorizes the Office of Youth Services to obtain criminal history record information on employees, prospective employees, and volunteers of its contracted providers and subcontractors, in positions that necessitate close proximity to youth when providing services on behalf of the OYS.

RELATING TO CHILD PROTECTION.

Requires the department of human services to make a good faith effort to locate, identify, and interview extended family members for possible foster custody placement of a child and to set forth the procedures used and steps taken in this regard in the dependency petition.

RELATING TO THE INVOLUNTARY TERMINATION OF PARENTAL RIGHTS OF KANAKA MAOLI.

Creates a Native Hawaiian Child Welfare Act preventing the involuntary termination of parental rights of Kanaka Maoli thus protecting the cultural and traditional rights of the Native Hawaiian people. This is also known as "The Kupuna Bill".

RELATING TO CHILD PROTECTION.

Provides immunity from prosecution for leaving an unharmed newborn at a hospital, fire station, or police station within 72 hours of birth. Provides immunity from liability for hospitals, fire stations, and police stations for receiving a newborn. Requires medical history from person relinquishing newborn.

Clarifies the importance of kinship placement for temporary foster placement and adoption; affirms the importance of the child's present attachment and bonding to present caregivers, whether kin or non-kin.

The purpose clarifies notice of hearings requirements and expand opportunities for foster parents to attend Child Protective Act hearings, to provide information and recommendations to the Family court and other parties in child welfare services cases with Family Court jurisdiction.

Allows foster children to apply for a driver's license with the written consent of the Department of Human Services. Requires a foster child's natural parents to pay for the child's car insurance and provides for free insurance if the child's parents are unable to pay. Allows higher education board allowances to be paid directly to former foster children.

Appropriates $200,000 for FY 2006-2007 to the Department of Human Services, Office of Youth Services Former Foster Child Assistance Program to assist former foster children between the ages of eighteen and twenty-four in job placement, skills training, education, and housing.

RELATING TO THE ESTABLISHMENT OF A TASK FORCE TO DETERMINE VISITATION RIGHTS FOR GRANDPARENTS AND HANAI INDIVIDUALS WHO ARE INFORMALLY RAISING THESE CHILDREN.

Establishes a joint legislative task force to determine visitation rights of grandparents and hanai individuals who raise grandchildren they have informally raised when biological parent is unable to do so.

Appropriates funds for the state commission on fatherhood.
