A BILL FOR AN ACT

 

RELATING TO SNAP TRAPS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 142, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§142- Snap traps prohibited; penalty. It shall be unlawful for any person to possess or use a snap trap within one thousand five hundred feet of any permanent residential structure. Any person who violates this section shall be guilty of a misdemeanor. Each day of violation of this section shall constitute a separate offense.

For the purposes of this section, "snap trap" means a device or machine primarily designed to capture an animal by injuring or killing the animal in a self-triggering spring-loaded metal clamp; provided that a snap trap does not include a mouse or rodent trap."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
