HOUSE CONCURRENT

RESOLUTION

 

REQUESTING THE department OF LAND AND NATURAL RESOURCES TO ESTABLISH USER ADVISORY COMMITTEES FOR THE SMALL BOAT HARBORS.

 

 

WHEREAS, small boat harbors are constructed, maintained, and operated for the purposes of recreational boating activities, the landing of fish, and commercial vessel activities; and

WHEREAS, the Department of Land and Natural Resources administers the state small boat harbors by organizing a comprehensive recreational boating program and by developing standard permits and fees for moorage in small boat harbors; and

WHEREAS, the Department's regulations involve mooring, anchoring, and docking, the embarking and disembarking of passengers, safety, conduct, recreational and commercial uses, the discharge of rubbish, refuse, and fuel or oils, with regard to small boat harbors, launching ramps, and boating facilities; and

WHEREAS, disputes are unavoidable between users of the small boat harbors and officials of the Department over issues such as proposed rules, proposed leases and permits, budgetary and funding matters, proposed fee increases or changes to permits or fee schedules, and proposed improvements; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, the Senate concurring, that the Department of Land and Natural Resources is requested to establish a user advisory committee to advise the Board of Land and Natural Resources on matters relating to the management of the small boat harbors that the Board administers; and

BE IT FURTHER RESOLVED that the Department is requested to establish one user advisory committee for each small boat harbor under the Board's jurisdiction, and that the advisory committee consist of users who retain a mooring permit for that small boat harbor and reside in the State of Hawaii; and

BE IT FURTHER RESOLVED that the Legislature requests that the duties and responsibilities of each user advisory committee shall be to advise the Department on all matters relating to the operation and management of the small boat harbor for which the advisory committee is responsible; and

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources.
