A BILL FOR AN ACT

 

RELATING TO HIGHWAY SAFETY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that immaturity and lack of driving experience make younger drivers a hazard on the road. Cell phones in the car give novice drivers one more distraction that they may not be able to manage as easily as more experienced drivers. The legislature further finds that under state law, instruction permits may be granted to drivers who are fifteen years and six months or older. The purpose of this Act is to prohibit drivers who have only a temporary instruction permit from using a wireless telephone while operating a motor vehicle.

SECTION 2. Section 286-110, Hawaii Revised Statutes, is amended by amending subsection (e) to read as follows:

"(e) No holder of a temporary instruction permit shall operate a motorcycle or a motor scooter during hours of darkness or carry any passengers. No holder of a temporary instruction permit shall operate a motor vehicle while using a wireless telephone."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
