A BILL FOR AN ACT

 

relating to naturopathy.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 455, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§455-   Authority to administer natural medicines by injection. The board by rule shall:

(1) Adopt a formulary of natural medicines that naturopaths may administer by injection;

(2) Establish the qualifications necessary to administer natural medicines by injection; and

(3) Grant the authority to qualified naturopaths to administer natural medicines by injection."

SECTION 2. Section 455-1, Hawaii Revised Statutes, is amended by amending the definition of "naturopathy" to read as follows:

""Naturopathy" means the practice of:

(1) Natural medicine, natural therapeutics, and natural procedures, for the purpose of removing toxic conditions from the body and improving the quality, quantity, harmony, balance, and flow of the vital fluids, vital tissues, and vital energy; and

(2) Diagnosing, treating, and caring for patients using a system of practice that bases its treatment of physiological functions and abnormal conditions on natural laws governing the human body: [utilizing] using physiological, psychological, and mechanical methods, such as air, water, light, sunshine, heat, [and] cold, earth, phytotherapy, physiotherapy, mechano-therapy, naturopathic corrections and manipulation, and natural methods or modalities, together with natural or homeopathic medicines, natural foods, [and] herbs, and nature's remedies of the type taught in education and training at naturopathic medical colleges.

The practice of naturopathy includes the administration of natural medicines using appropriate methods, including injection as authorized by the board. The practice of naturopathy excludes surgery, application of x-rays, and prescribing, dispensing, or using prescription drugs except as provided for in the definition of natural medicine."

SECTION 3. (a) The department of commerce and consumer affairs shall establish a temporary advisory committee on the administration of natural medicines by injection. The advisory committee shall be composed of:

(1) Two persons licensed as naturopathic physicians under chapter 455 and appointed by the board of examiners in naturopathy;

(2) One person licensed in medicine under chapter 453 and appointed by the board of medical examiners;

(3) One person licensed as a pharmacist under chapter 461 and appointed by the board of pharmacy; and

(4) One representative of a school of naturopathy accredited by or that has received candidacy status with a regional or national accrediting agency recognized by the United States Department of Education, to be appointed by the board of examiners in naturopathy.

(b) The temporary advisory committee on the administration of natural medicines by injection shall develop and submit recommendations to the board of examiners in naturopathy on:

(1) A formulary of natural medicines that naturopaths may administer by injection; and

(2) The qualifications necessary for administering natural medicines by injection.

The temporary advisory committee on the administration of natural medicines by injection shall serve without compensation, and shall be dissolved upon the approval of rules establishing a formulary and qualifications pursuant to this Act.

SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
