Requires all voting systems to have a voter verified paper audit trail, and preliminary election results to be released at polling places. Provides for mandatory election recounts when the difference n results is ½ of 1% or less. RELATING TO FORFEITURE OF BENEFITS FOR CONVICTED FELONS.

Requires an employee convicted of a felony in violation of his/her duties as a public servant to forfeit most future benefits set forth in chapters 87A and 88. Establishes a hearing process unless the grounds for the forfeiture are established by the court in which the employee was convicted.

RELATING TO CHARTER SCHOOLS.

Repeals the current statutory "cap" of 25 new century charter schools and 23 conversion charter schools. Proposes an amendment to the Constitution to allow the Governor to appoint a voting member to the BOE from charter school parents, administrators, faculty and staff. Creates a new public charter schools statutory chapter, which authorizes the establishment of charter schools and sets forth powers, responsibilities, and administrative and governance provisions.

RELATING TO THE LAND USE COMMISSION.

Reconstitutes the Land Use Commission (LUC) as a quasi-legislative body for the conduct of periodic reviews of land use district boundaries for important agricultural and natural resource areas. Directs the counties to make land use district boundary amendment decisions. Allows the LUC to act as an appellate body for the purpose of appealing boundary amendment county decisions.

RELATING TO COLLECTIVE BARGAINING FOR PUBLIC EMPLOYMENT.

Excludes public employees covered by collective bargaining under chapter 89 from certain sections of the uniform arbitration act.

RELATING TO PUBLIC SECTOR COLLECTIVE BARGAINING REFORM.

Amends chapter 89 by removing BU-03, 08, and 13 from binding arbitration to allow these bargaining units to strike. Excludes supervisory classes from collective bargaining, except for certain supervisors in units 9, 10, 11 and 12.

RELATING TO BINDING ARBITRATION.

Modifies factors that the arbitration panel must consider in public employee bargaining arbitration decisions in order to: (1) take into consideration the impact an arbitration decision affecting one bargaining unit may have on arbitrated decisions of other bargaining units and negotiations with non-arbitration bargaining units; (2) comply with constitutional and statutory appropriation and budgeting provisions; and (3) provide for comparison with private sector employees in the State.

RELATING TO PUBLIC MEETINGS.

Clarifies that two members of a board may discuss official board business outside of a meeting, limited only by the requirement that no commitment to vote is make or sought. Also allows two or more members of a board, but less than the number of members which would constitute a quorum, to discuss matters relating to official board business at meetings of another board or at public hearings of the Legislature provided that: (1) the members announce their intent to attend such meeting or hearing at a noticed meeting of the board; and (2) the members report their attendance and the discussion at a subsequent meeting.

RELATING TO THE OFFICE OF INFORMATION PRACTICES.

Requires notification to the Office of Information Practices (OIP) of any civil lawsuit filed involving the Sunshine Law and to allow the OIP to intervene in such action. Requires approval by the OIP instead of the Attorney General for an emergency meeting under section 92-8 (b). Grants the OIP authority, concurrent with the Attorney General, to civilly enforce violations of the Sunshine Law. Allows the OIP to seek to enforce in the courts any decision issued in accordance with section 92F-15.5.

RELATING TO THE UNIFORM INFORMATION PRACTICES ACT (MODIFIED).

Allows agencies to withhold certain personal identifying information, such as home addresses and social security numbers, in records required to be disclosed under section 92F-12 (a), where disclosure of the information would be a clearly unwarranted invasion of personal privacy.

Makes an emergency appropriation for and increases the spending ceiling of the State Risk Management Revolving Fund by $25,000,000 to $35,450,000 and general revenues of the State of Hawaii for fiscal year 2004-2005 to pay for unanticipated losses which were incurred by the University of Hawaii as a result of the October 30, 2004 flood, that will exceed the current appropriation and spending ceiling.

RELATING TO CHILD SUPPORT ENFORCEMENT.

Provides the authority for the Child Support Enforcement Agency (CSEA) to provide services to non-custodial parents, allows disclosure of information in administrative proceedings, and the issuance of income withholding orders. Requires the non-custodial parent to keep the CSEA informed of medical insurance coverage. Enables the CSEA to notify employers of the requirement to provide medical insurance coverage by regular mail or transmission by electronic means.

Creates 2 new offenses related to illegal compensation of public servants: bribery in the second degree and unlawful gift to public servants by persons subject to their jurisdiction.

Provides for a mandatory sentence of 30 years to life for habitual violent felons. Adds 15 serious class C felonies to those offenses subject to repeat offender sentencing. Makes defendants convicted of class A felony drug offences and recidivist drug offenders ineligible for lenient sentencing. Amends the repeat offender statute.

PROPOSING AN AMENDMENT TO THE CONSTITUTION OF THE STATE OF HAWAII RELATING TO TESTIMONY OF DEFENDANTS IN CRIMINAL CASES.

Proposes an amendment to the Constitution to permit testifying criminal defendants to be impeached with evidence of prior convictions for crimes involving dishonesty.

Requires businesses engaged in the sale of cigarettes and other tobacco products at the retail level to acquire a retail tobacco permit from the Department of Taxation. Provides criminal penalties for the retail sale of cigarettes or other tobacco products without a valid retail tobacco permit, and for the seizure and for forfeiture of cigarettes and other tobacco products sold, possessed, dept, acquired, distributed, or transported without a valid retail tobacco permit.

RELATING TO TESTIMONY.

Adopts a uniform standard based on the Federal Rules of Evidence to ensure the admissibility of reliable, trustworthy, and relevant lay and expert testimony in judicial proceedings.

RELATING TO TORT ACTIONS.

Reiterates the underlying intent of the discretionary function and the intentional tort exception to the State's waiver of sovereign immunity for the torts of its employees. Provides the State with immunity when it exercises its discretion in planning and design activities. Clarifies section 663-10.5, which limits the liability of government entities to that percentage share of damages attributable to the entities.

Authorizes immediate appeals from orders regarding preliminary injunctions and from denials of sovereign, absolute, or qualified immunity.

Reduces the interest on judgments recovered in civil suits from the current 10% a year to a financial market rate, based upon the yield for treasury bonds with a one-year maturity.

Prohibits the counting of blank votes and overvotes in determining whether a proposed constitutional amendment has been ratified.

RELATING TO CHARITABLE GIFT ANNUITIES.

The purpose of this bill is to clarify that: (1) the filing deadline for charities that issue charitable gift annuities to annually certify to the Attorney General the charities' compliance with the minimum net asset and reserve requirements of section 431:1-204, Hawaii Revised Statues; (2) the calculation of a charity's reserves on gift annuities shall be based upon mortality tables and discount rates determined by the Insurance Commissioner; (3) the requirement that a charity must conduct business in Hawaii for at least ten consecutive years rather than"continuously;" and (4) no reserve "surplus" is required for any portion of a gift annuity that is reinsured by an authorized insurer.

RELATING TO THE DISPOSITION OF VEHICLES, VESSELS, AND AIRCRAFT.

Expressly provides an owner, lien holder, or other person with interest in a derelict or abandoned vehicle, vessel, or aircraft with notice and the opportunity to request a post-custodial administrative hearing before disposition of the vehicle, vessel, or aircraft.

Facilitates the interstate exchange of criminal history informatioin for noncriminal justice purposes, including but not limited to, backround checks for the licensing and screening of employees and volunteers.

Adds definitions for "criminal history record check" and "criminal history record name inquiry." Updates the fee schedule for criminal history record check services to include criminal history record checks done via the Internet. Requires the Hawaii Criminal Justice Data Center to take a full frontal photograph of an applicant's face for a Hawaii state identification card.

Provides for identification by means of DNA testing of all felons, and provides for less intrusive and more economical methods of testing. Requires DNA testing of each person arrested for a felony. Extends the statute of limitations in cases where DNA has been recovered as evidence. Provides for post-conviction DNA testing, and funding (750,000) to implement the new DNA testing program.

RELATING TO NUISANCE ABATEMENT.

Clarifies the standard of proof in a nuisance abatement suit is preponderance of the evidence. Authorizes the court to issue a protective order authorizing the nondisclosure of the identity of witnesses upon a showing of prior threats or acts of violence. Allows a court to order the suspension and/or revocation of a business, professional, operational, or liquor license.

Requires judges to suspend the driver's licenses of licensed drivers under the age of 21 when the drivers have been convicted of illegal possession of liquor and if the defendant does not yet have driver's license, to postpone eligibility until the defendant is eighteen years of age or for ninety days, whichever period is loner. Allows a judge the discretion to permit limited driving for those with a suspended license for employment or educational purposes.

Prohibits qualification for both the production expenditure tax credit and the investment tax credit, in a given year. Sets a minimum Hawaii production spending requirement of $200,000 for productions to qualify for the credit. Caps claims at $7 million per year per production.
