RELATING TO MOTOR VEHICLES.

Exempts members of the national guard and reserves from county vehicular taxes and fees for noncommercial motor vehicles.

RELATING TO THE MILITIA.

Allows the Adjutant General to appoint an Assistant Adjutant General for a newly established joint headquarters component of the State National Guard at a grade no higher than major general.

RELATING TO CLEAN WATER.

Increases, from $25,000 to $40,000, the fine for each violation of the water pollution law, or any rule, permit, or variance issued under that law. Enacts provisions relating to muddy water. Allows citizen suits.

RELATING TO DRUG REHABILITATION HOMES IN RESIDENTIAL AREAS.

Repeals provisions in Hawaii Revised Statutes allowing certain drug rehabilitation homes to be located in residential areas.

Requires the state director of finance to transmit revenues received from all unadjudicated traffic violations or infractions to the police department of the county in which the traffic infraction occurred to enable each chief of police to recruit and retain qualified police officers.

Authorizes the board of regents of the University of Hawaii to develop internal policies and procedures for the procurement of goods, services, and construction not subject to the procurement code.

Appropriates premiums and earnings from sales and investment of proceeds of revenue bonds issued by the board of regents of the University of Hawaii to the University for the continued construction of the university health and wellness center, including the new medical school facility.

RELATING TO EMPLOYER'S SHARE OF FRINGE BENEFITS COSTS INCURRED ON SALARIES CHARGED TO SPECIAL AND REVOLVING FUNDS OF THE UNIVERSITY OF HAWAII.

Establishes that the fringe benefit costs for University of Hawaii employees whose salaries are paid through special or revolving fund revenues shall instead be paid with general funds.

RELATING TO THE MANAGEMENT OF UNIVERSITY OF HAWAII LANDS.

Clarifies the authority of the University of Hawaii to manage any real property owned or leased by the university or otherwise under its control by authorizing the board of regents to adopt rules pursuant to chapter 91, Hawaii Revised Statutes, relating to public activities permitted or occurring on university lands.

Authorizes the issuance of revenue bonds to finance university housing units.

Makes the optional retirement plan for University of Hawaii employees permanent. Changes the limit on how much the State contributes to the optional retirement plan on behalf of the employee by removing the $100,000 ceiling and tying the ceiling to the federal tax limit on annual compensation as set forth in the Internal Revenue Code.

Authorizes the director of human services to use the federal supply schedule for the negotiation and purchase of brand name prescription drugs in connection with prescription drug programs administered by the State.

Requires quarterly reports from manufacturers of prescription drugs dispensed in the State. The quarterly reports shall disclose the: average wholesale price; wholesale acquisition cost; average manufacturer price; and the best price.

RELATING TO PRESCRIPTION DRUG COST CONTAINMENT AND AFFORDABLE ACCESS.

Requires drug manufacturers to disclose value and purpose of gifts or economic benefits of $25 or more that are provided to health care professionals in promotional or marketing activities; requires director to establish pharmacy best practices and cost control program and to implement program for medicaid and other state public assistance health benefits plans; establishes drug utilization review board; requires director to request section 1115 waiver to maximize federal participation in state drug programs.

Amends the examination provisions of the dentist and dental hygienist licensing laws by requiring applicants to pass one of four regional examinations given after January 1, 2005, until a national examination becomes available.

Deletes the phrase "actions in the nature of assumpsit" from the types of actions for which the prevailing party's attorneys' fees may be taxed by the court as fees to be paid by the losing party, and adds qualification that losing plaintiff must allege an amount sued for before attorneys fees can be assessed.

RELATING TO THE UNIFORM ATHLETE AGENTS ACT.

Enacts the Uniform Athlete Agents Act to protect student-athletes and educational institutions. Provides for registration of athlete agents, the required form of contract, the right of the student athlete to cancel an agency contract, disclosure requirements relating to record maintenance, reporting, renewal, notice, warning, and security. Provides for reciprocity among the States.
