A BILL FOR AN ACT

 

relating to childhood surveillance systems.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A- Childhood data and surveillance systems. (a) The department shall establish a childhood data and surveillance system to track the body mass index of children. The department shall record the height, weight, birth date, and sex of a child each time the child transfers to another public school. The department shall also record the date of the transfer and may also record the ethnicity of the child.

(b) The department shall allow the department of health access to the data gathered in subsection (a); provided that:

(1) The data is anonymized;

(2) Access to the data complies with the federal Health Insurance Portability and Accountability Act and the Education Rights and Privacy Act; and

(3) Used strictly for public health purposes.

(c) For the purposes of this section:

"Anonymized" means and refers to data that, in and of itself, does not reveal the identity of the person that is the object of the data.

"Body mass index" means a formula using a person's height and weight to determine the overall health of the person."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
