A BILL FOR AN ACT

 

making an APPROPRIATION FOR THE CONSTRUCTION OF AFFORDABLE HOUSING IN HANA, MAUI.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. There is presently a housing crisis in Hana, Maui. The living conditions are grossly overcrowded, with people living in tents and using outhouses for shelter. Some homes have up to three generations living in them, due to lack of affordable housing options. The $400,000 median sales price for homes on Maui is the highest in the State. This makes it virtually impossible for the average family to buy its own home.

Hana Ranch has dedicated one hundred acres to the community to build affordable housing. Of this, fifteen acres were donated to Self Help Housing Corporation of Hawaii to develop fifty-three to fifty-five single family lots. The one hundred acres are expected to last the community for generations and remaining phases will be released on an as-needed basis.

The legislature finds and declares that the issuance of general obligation bonds under this Act is in the public interest and for the public health, safety, and general welfare of the State.

The purpose of this Act is to issue general obligation bonds for a grant-in-aid to Hana Ranch Affordable Housing Project to assist in the planning and construction of affordable housing units in Hana, Maui.

SECTION 2. The director of finance is authorized to issue general obligation bonds in the sum of $5,546,940, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2005-2006 for a grant-in-aid to Hana Ranch Affordable Housing Project for the planning and construction of affordable housing units in Hana, Maui, on land donated by Hana Ranch.

The general obligation bonds issued under this Act shall be issued pursuant to part I, chapter 39, Hawaii Revised Statues, relating to the power to issue general obligation bonds.

SECTION 3. The funds generated by the issuance of general bonds shall not be released to Hana Ranch Affordable Housing Project until it submits to the housing and community development corporation of Hawaii a building plan that is Leadership in Environmental Energy and Design silver certified by the standards of the United States Green Building Council.

SECTION 4. The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2008, shall lapse as of that date.

SECTION 5. The sum appropriated shall be expended by the department of human services for the purposes of this Act.

SECTION 6. This Act shall take effect on July 1, 2005.
