RELATING TO MENTAL HEALTH.

Allows the department of health to expand its capacity to obtain verifiable information regarding the criminal history of potential employees and contract providers to both mental health divisions. Requires the Department of Health to establish and operate a community-based mental health system. Bases development upon an annual statewide comprehensive integrated service plan that is the cumulative result of comprehensive integrated service area planning within each county.

Establishes the public health nursing services program, and sets forth the roles and functions of the program in the delivery of direct clinical nursing services. (SD2)

RELATING TO PROFESSIONAL COUNSELORS.

Establishes licensure for mental health counselors effective 7/1/05, but exempts government employees. Allows licensing of counselors with current national certification who pass exam and pay fees within year of program commencing. Assesses surcharges to fund start-up costs. Appropriates general funds. (SD2)

RELATING TO A PRESCRIPTION DRUG REPOSITORY PROGRAM.

Provides for a prescription drug repository to receive and dispense donated prescription drugs to needy persons. (SD2)

RELATING TO EMERGENCY MEDICAL SERVICES.

Establishes an emergency medical services special fund to be funded by fee on registration for motor vehicles. Appropriates funds for additional ambulance services for parts of Oahu, Maui, and Hawaii, and for professional development and training for paramedics on Kauai, Maui, and Hawaii. (SD2)

RELATING TO TOBACCO.

Requires businesses engaged in the sale of cigarettes and other tobacco products at the retail level to acquire a retail tobacco permit from DOTAX. Provides criminal penalties for the retail sale of cigarettes or other tobacco products without a valid retail tobacco permit, and the seizure and forfeiture of cigarettes and other tobacco products sold, possessed, kept, acquired, distributed, or transported without a valid retail tobacco permit. RELATING TO THE PATIENTS' BILL OF RIGHTS AND RESPONSIBILITIES ACT.

Authorizes the payment of a flat fee of $200 for a physician member appointed by the insurance commissioner for service on each review panel under the Patients' Bill of Rights and Responsibilities Act. Exempts the payment and selection of the physician from the state procurement code. (SD1)

RELATING TO MENTAL HEALTH AND ALCOHOL AND DRUG ABUSE INSURANCE.

Increases minimum coverage for alcohol and drug dependence benefits to two episodes per year. Includes obsessive compulsive disorder, dissociative disorder, delusional disorder, and major depression within definition of "serious mental illness". (SD2)

RELATING TO HOSPITAL AND PROFESSIONAL LIABILITY RISK FINANCING.

Permits Hawaii Health Systems Corporation to create a captive insurance company to provide malpractice coverage to the DOH, UH School of Medicine, and other governmental or quasi-governmental entities providing health care. Requires each insured to be represented on the board of directors. Appropriates $    . (SD2)
