SENATE RESOLUTION

 

requesting a management and financial audit of the department of public safety, narcotics enforcement division.

 

WHEREAS, numerous complaints and long standing concerns have been expressed to the State Department of Public Safety ("DPS") by Narcotics Enforcement Division ("NED") personnel regarding the financial and managerial oversight of NED; and

WHEREAS, some of these concerns include and are related to:

(1) Fiscal management;

(2) Favoritism and bias within NED;

(3) The safety and well-being of NED employees;

(4) Mishandling of evidence;

(5) Lack of accountability and productivity within NED;

(6) Improper oversight of programs and personnel; and

(7) Mishandling and lack of fair allocation of resources within NED; and

WHEREAS, NED personnel have expressed to DPS their conviction that an independent audit of NED is necessary based on these concerns; and

WHEREAS, no independent review of NED has yet occurred as a result of the concerns that have been voiced; and

WHEREAS, among other things, an audit of NED would help to:

(1) Verify any concerns and complaints of the public and NED professionals;

(2) Pinpoint areas of weakness within NED and any areas that need follow up;

(3) Provide an assessment of any actions or efforts taken by DPS, or NED, to address any of the concerns mentioned above and to remedy the problems; and

(4) Recommend ways to address any other concerns or problems existing at NED; and

WHEREAS, an audit would further serve to improve the functioning and fiscal condition of NED, as well as maximize staff efficiency and the prudent use of resources; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-Second Legislature of the State of Hawaii, Regular Session of 2004, that the Legislative Auditor is requested to perform a management and financial audit of the Department of Public Safety, Narcotics Enforcement Division; and

BE IT FURTHER RESOLVED that the office of the Legislative Auditor report its findings to the Legislature no later than twenty days prior to the convening of the Regular Session of 2005; and

BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Legislative Auditor and the Director of Public Safety.
