SENATE CONCURRENT

RESOLUTION

 

REQUESTING THE AUDITOR TO CONDUCT A SUNRISE REVIEW OF THE REGULATION OF hypnotherapists.

 

 

WHEREAS, the Legislature finds there is a need to regulate hypnotherapists by requiring licensure; and

WHEREAS, Senate Bill No. 2497 was introduced in the 2002 regular legislative session to regulate hypnotherapists; and

WHEREAS, section 26H-6, Hawaii Revised Statutes, requires the Legislature, by Concurrent Resolution, to refer to the Auditor a request for analysis of any new regulatory measure being considered for enactment that, if enacted, would subject unregulated professions and vocations to licensing or other regulatory controls; and

WHEREAS, Senate Concurrent Resolution No. 16, requesting a sunrise review of the regulation of hypnotherapists, was duly adopted unamended by both bodies of the Legislature during the 2002 Regular Session; and

WHEREAS, a certified copy of the Concurrent Resolution was sent to the Auditor in May 2002; and

WHEREAS, if regulated, hypnotherapists will have to meet certain educational, examination, and experience provisions; and

WHEREAS, hypnotherapists in their work will affect the emotional, mental, economic, and psychological well-being of individuals and families; and

WHEREAS, other professionals in similar fields such as psychologists, social workers, case managers, psychiatrists, nurses, ministers, school counselors, and others may be impacted; and

WHEREAS, the broader consuming public may also be affected if the costs of seeking hypnotherapy help are affected by licensure and regulation; and

WHEREAS, due to work priorities, the Auditor did not perform the sunrise review of hypnotherapists based on Senate Bill No. 2497 and did not submit the sunrise review to the Legislature either prior to, or subsequent to, the convening of the Regular Session of 2003; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-second Legislature of the State of Hawaii, Regular Session of 2004, the House of Representatives concurring, that the Auditor is requested, to perform the sunrise review requested through Senate Concurrent Resolution No. 16 (2002) of the regulation of hypnotherapists as provided for in Senate Bill No. 2497, as introduced during the Regular Session of 2002; and

BE IT FURTHER RESOLVED that the Auditor is requested to specifically analyze the following areas, in addition to any other areas required by statute:

(1) The costs and benefits of the activities of hypnotherapists for the consumer; and

(2) A summary of existing laws in the other states that do and do not license hypnotherapists;

and

BE IT FURTHER RESOLVED that the Auditor is requested to submit findings and recommendations to the Legislature no later than twenty days prior to the convening of the Regular Session of 2005; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and to the Director of Commerce and Consumer Affairs.
