SENATE CONCURRENT

RESOLUTION

 

requesting an audit of the department of transportation's contracts for solid waste disposal and recycling.

 

WHEREAS, with the State's landfills rapidly filling, along with the proliferation of illegal dumping in Hawaii, proper disposal of solid waste and recycling programs have become increasingly vital to the environmental and social health of the State; and

WHEREAS, a large portion of the solid waste and recyclable materials generated in the State is produced by various state agencies and their contractors; and

WHEREAS, under the Hawaii Revised Statutes, solid waste may only be stored or disposed of by an entity that has a permit issued by the Department of Health and that stores and disposes of solid waste in an appropriate manner; and

WHEREAS, the public, news media, and industry representatives have reported instances in which solid waste and recyclable materials produced by a state agency, particularly the state Department of Transportation, are improperly stored or disposed of; and

WHEREAS, there have also been reports that solid waste produced by state agencies, particularly the Department of Transportation, has been stored or disposed of by entities that either do not have the proper permits or do not pay the rental fees required of other companies; and

WHEREAS, the Office of the Auditor is charged with the responsibility to review the practices of state agencies to ensure that the State's laws, including permitting requirements, are applied fairly and evenly; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-Second Legislature of the State of Hawaii, Regular Session of 2004, the House of Representatives concurring, that the Auditor is requested to perform an audit of all contracts and other agreements for solid waste disposal or recycling between the Department of Transportation and any other entity; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Transportation and the Auditor.
