SENATE CONCURRENT

RESOLUTION

 

Proposing an increase in recycling by state AND COUNTY agencies by requesting the IMPLEMENTATION OF RECYCLING PROGRAMS AND ANNUAL reports concerning purchase and use of goods made from recycled materials, the ESTABLISHMENT of incentives to increase procurement of recycled goods, and the adoption of rules to increase the percentages of preference for products containing recycled material.

 

WHEREAS, recycling is an integral and important part of integrated solid waste management, especially in an island state such as Hawaii; and

WHEREAS, state and county agencies' implementation of a recycling program and the use of recycled content and other products made in Hawaii would serve several worthy pursuits; and

WHEREAS, the use of materials with recycled content would encourage the diversion of recyclable waste from Hawaii's limited landfill space and stimulate our economy; both of these goals are environmentally and economically sound in other jurisdictions and should be pursued; and

WHEREAS, the purchasing power of state and county agencies can positively impact the market for recycled products in Hawaii; and

WHEREAS, annual reports submitted to the Legislature by the Department of Health indicate that there is considerable potential for improving the State's purchasing record concerning recycled products; annual reports submitted to the Legislature that provide information on the amount and type of goods made from recycled materials that are purchased and used by state agencies would provide helpful information in determining the state of recycling efforts among government agencies; and

WHEREAS, section 103D-1005, Hawaii Revised Statutes, currently encourages the use of recycled products by requiring that contracts be awarded to the lowest responsible and responsive bidders, with preference being given to products containing recycled materials; and

WHEREAS, section 103D-1005, Hawaii Revised Statutes, also requires the State Procurement Office, with the assistance of the Solid and Hazardous Waste Branch of the Department of Health, to develop a recycled product procurement program that requires state purchasing agencies and urges county purchasing agencies to apply a preference to purchasing products with recycled content and to avoid the purchase of products that are environmentally harmful; and

WHEREAS, under the same law, the Procurement Policy Board is required to adopt rules governing preference for recycled products, including establishing percentages of preference; and

WHEREAS, although both state and county agencies are required to adhere to the recycled product procurement program, there has not been established any minimum amounts of products containing recycled materials to be purchased by state and county agencies; and

WHEREAS, section 342G-43, Hawaii Revised Statutes, requires each state agency conducting procurement activities to annually submit information and data to the Office of Solid Waste Management of the Department of Health regarding:

(1) The progress of the agency in developing procurement programs;

(2) The total amount of paper purchased during the year; and

(3) The amount of recycled goods purchased during the year compared to non-recycled counterparts; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-second Legislature of the State of Hawaii, Regular Session of 2004, the House of Representatives concurring, that all state and county government agencies are requested to create and implement recycling and waste reduction programs for all state and county government buildings and offices; and

BE IT FURTHER RESOLVED that all state and county agencies are requested to submit an annual report to the Department of Health, which in turn is requested to submit annual reports to the Legislature, on the amount of goods each agency has used that are made from recycled materials, including dollar amounts, tonnage, and what materials are recycled; and

BE IT FURTHER RESOLVED that the State Chief Procurement Officer with the assistance of the Office of Solid Waste Management within the Department of Health is requested to propose legislation to create incentives within the procurement code that would support the procurement of recycled products by state and county agencies; and

BE IT FURTHER RESOLVED that the Procurement Policy Board is requested to adopt rules in accordance with chapter 91, Hawaii Revised Statutes, to:

(1) Increase the percentages of preference for products containing recycled material purchased by state and county agencies; and

(2) Set minimum amounts of products containing recycled material to be purchased by state and county agencies; and

BE IT FURTHER RESOLVED that the Procurement Policy Board is requested to submit a report of its progress on the adoption of rules to the Legislature no later than twenty days prior to the convening of the Regular Session of 2005; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor, the President of the Senate, the Speaker of the House of Representatives, the Director of Finance, the Director of Health, the Attorney General, the State Procurement Officer, the Chairperson of the Procurement Policy Board, and the Comptroller, who is requested to transmit copies to all other state departments and agencies, and Chairperson of the county council and the Mayor of each county, who in turn is requested

to transmit copies to all other applicable county departments and agencies.
