SENATE CONCURRENT

RESOLUTION

 

requesting the director of Health to adopt rules to set a time limit on the storage of solid waste, special waste, and hazardous waste in the State by any person.

 

WHEREAS, "solid waste" is defined in section 340A-1, Hawaii Revised Statutes, to mean "...garbage, refuse and other discarded solid materials, including solid waste materials resulting from industrial and commercial operations, and from community activities. Solid waste does not include solid or dissolved material in domestic sewage or other substances in water sources, such as silt, dissolved or suspended solids in industrial waste effluents, dissolved materials in irrigation return flows or other water pollutants. This definition is also intended to include liquid waste materials such as waste oil, paints, and solvents"; and

WHEREAS, "special waste" refers to used lead acid batteries and used motor vehicle tires pursuant to chapter 340I, Hawaii Revised Statutes; and

WHEREAS, "hazardous waste" is defined in section 342J-2, Hawaii Revised Statutes, to mean "a solid waste, or combination of solid wastes, which because of its quantity, concentration, or physical, chemical, or infectious characteristics may:

(1) Cause or significantly contribute to an increase in mortality or an increase in a serious irreversible or incapacitating reversible illness; or

(2) Pose a substantial existing or potential hazard to human health or the environment when improperly treated, stored, transported, disposed of, or otherwise managed"; and

WHEREAS, the temporary storage of solid waste, special waste, and hazardous waste, to the extent currently permitted by law, is subject to abuse when waste is stored indefinitely, thus placing the public's health and safety at risk; and

WHEREAS, there is a need to regulate the temporary storage of solid waste, special waste, and hazardous waste in the State; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-Second Legislature of the State of Hawaii, Regular Session of 2004, the House of Representatives concurring, that the Director of Health is requested to adopt rules in accordance with chapter 91, Hawaii Revised Statutes, to set a time limit on the storage of solid waste, special waste, and hazardous waste in the State by any person; and

BE IT FURTHER RESOLVED that in adopting rules, the Director of Health is requested to consider the term "storage", in the context of waste management, to mean the collecting, transporting, stockpiling, and storing of solid waste, special waste, or hazardous waste for a temporary period in a manner that does not constitute disposal"; and

BE IT FURTHER RESOLVED that the Director of Health is requested to report the Department's progress on the adoption of rules to the Legislature no later than twenty days prior to the convening of the Regular Session of 2005; and

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Director of Health.
