SENATE CONCURRENT

RESOLUTION

 

REQUESTING THAT THE BOARD OF LAND AND NATURAL RESOURCES REPORT TO THE LEGISLATURE ON the progress of the division of boating and OCEAN recreation in addressing THE AUDITOR'S concerns in the 1998 AND 2001 AUDITS OF THE MANAGEMENT OF STATE BOATING FACILITIES.

 

WHEREAS, the Auditor conducted audits of the Department of Land and Natural Resources' management of the State's boating facilities in 1993, 1998, and 2001; and

WHEREAS, the Auditor has repeatedly indicated serious flaws in the management of the boating program and, specifically, the 1998 and 2001 audits found gross mismanagement and neglect by the Division of Boating and Ocean Recreation and the Board of Land and Natural Resources; and

WHEREAS, among the flaws, the Auditor cited ineffective financial controls, incomprehensible rules, and absence of a statewide plan; and

WHEREAS, the Auditor's report made several recommendations to improve the Division of Boating and Ocean Recreation's administration of the boating program; and

WHEREAS, the commercial boating industry in Hawaii continues to report inconsistencies in management and enforcement, arbitrary regulations, and a lack of accountability within the Division of Boating and Ocean Recreation; and

BE IT RESOLVED by the Senate of the Twenty-Second Legislature of the State of Hawaii, Regular Session of 2004, the House of Representatives concurring, that the Board of Land and Natural Resources is requested to report to the Legislature on its efforts to remedy the problems identified by the Auditor's 1998 and 2001 audits of the management of state boating facilities by the Department of Land and Natural Resources no later than twenty days prior to the convening of the Regular Session of 2005; and

BE IT FURTHER RESOLVED that the report shall provide a detailed explanation for the delay or failure to address each concern identified by the Auditor and a detailed explanation and rationale for the delay or failure to implement the Auditor's recommendations; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the President of the Senate, the Speaker of the House of Representatives, the Chairperson of the Board of Land and Natural Resources, the Director of the Division of Boating and Ocean Recreation, and the Auditor.
