A BILL FOR AN ACT

 

RELATING TO CHILDREN AND YOUTH.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that millions of children are on their own in the morning and afternoon before and after the school bell rings. Nationally, nearly two-thirds of school-age children are in homes with working parents, yet very few communities have a comprehensive system of before and after-school care for children. As a result, children are unsupervised in the afternoon and early evening hours, and statistics clearly show that rates of juvenile crime, drug use, and experimentation with tobacco, alcohol, and sex increase during this period.

The legislature further finds that there is widespread agreement about the importance of establishing safe, structured learning environments for children and youth during the out-of-school hours. At issue is how best to pay for these programs.

The purpose of this Act is to establish a designated, stable source of funding for nonschool-hour programs for children and youth and to appropriate funds for these programs.

SECTION 2. Section 328L-2, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

"(b) The fund shall be used for the purpose of receiving, allocating, and appropriating the tobacco settlement moneys as follows:

(1) [Twenty-four and one-half] Eighteen and one-half per cent shall be appropriated into the emergency and budget reserve fund under section 328L-3;

(2) Thirty-five per cent shall be appropriated to the department for purposes of section 328L-4;

(3) Twelve and one-half percent per cent shall be appropriated into the Hawaii tobacco prevention and control trust fund under section 328L-5; [and]

(4) Twenty-eight per cent shall be appropriated into the university revenue-undertakings fund created in section 306-10, to be applied solely to the payment of the principal of and interest on, and to generate required coverage, if any, for, revenue bonds issued by the board of regents of the University of Hawaii to finance the cost of construction of a university health and wellness center, including a new medical school facility, to be situated on the island of Oahu, for the succeeding fiscal year; provided that any moneys in excess of the amount required to pay principal of and interest on, and to generate required coverage, if any, for such revenue bonds in any fiscal year, shall be transferred to the emergency and budget reserve fund under section 328L-3, and the Hawaii tobacco prevention and control trust fund under section 328L-5, in the succeeding fiscal year, in the same proportion as to the amount of moneys appropriated to those funds in accordance with this subsection[.];

(5) Two per cent shall be appropriated to the department of human services office of youth services for nonschool-hour programs for sixth to eighth graders;

(6) Two per cent shall be appropriated to the department of education for nonschool-hour programs for sixth to eighth graders; and

(7) Two per cent shall be appropriated to the counties' department of parks and recreation for nonschool-hour programs."

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $3,000,000, or so much thereof as may be necessary for fiscal year 2003-2004, and the sum of $3,000,000, or so much thereof as may be necessary for fiscal year 2004-2005, for nonschool-hour programs for sixth to eighth graders provided by private nonprofit community-based agencies.

The sums appropriated shall be expended by the department of human services, office of youth services, for the purposes of this Act.

SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $3,000,000, or so much thereof as may be necessary for fiscal year 2003-2004, and the sum of $3,000,000, or so much thereof as may be necessary for fiscal year 2004-2005, for nonschool-hour programs for sixth to eighth graders.

The sums appropriated shall be expended by the department of education for the purposes of this Act.

SECTION 5. There is appropriated out of the general revenues of the State of Hawaii the sum of $3,000,000, or so much thereof as may be necessary for fiscal year 2003-2004, and the sum of $3,000,000, or so much thereof as may be necessary for fiscal year 2004-2005, for nonschool-hour programs.

The sums appropriated shall be expended by the counties' departments of parks and recreation for the purposes of this Act, and subject to the following allocation percentages (based on the number of children from birth to age eighteen in each county) and appropriation amounts:

(1) Honolulu 71% $2,130,000/FY

(2) Maui 11% $  330,000/FY

(3) Hawaii 13% $  390,000/FY

(4) Kauai  5% $  150,000/FY

SECTION 6. Funds appropriated by this Act shall be awarded by the expending agencies only to nonschool-hour programs that demonstrate a commitment to partnering with the public and private sectors and involve active participation by youth in all phases for the purposes of program planning, implementation, and evaluation. All programs that receive funds pursuant to the above appropriations shall meet each quarter with their community partners for purposes of program evaluation and improvement.

SECTION 7. The department of human services, office of youth services, department of education, and counties shall convene annually to share best practices and outcome information and shall submit to the legislature an annual report on the programs funded under this Act no later than twenty days before the convening of each regular session.

SECTION 8. The appropriations for nonschool hour programs authorized in this Act for fiscal year 2003-2004, shall not lapse at the end of that fiscal year and shall carry over and may be expended in fiscal year 2004-2005, for the purposes for which the funds were appropriated.

SECTION 9. The appropriations authorized in this Act shall not reduce existing funding for nonschool-hour programs.

SECTION 10. Notwithstanding any law to the contrary, all procurement contracts for the provision of nonschool-hour programs funded by the appropriations authorized in this Act shall be exempt from chapters 103D and 103F, Hawaii Revised Statutes.

SECTION 11. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 12. This Act shall take effect on July 1, 2003.
