A BILL FOR AN ACT
RELATING TO UNIFORM HEALTH CARE DECISION ACT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 327E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§327E- Wrist band identification for end-of-life decisions. (a) Upon providing a copy of a valid durable power of attorney for health-care decisions form under section 327E-16, a health-care provider shall provide a wrist band identification to the person that executed the durable power of attorney for health-care decision, if the person has chosen an end-of-life decision not to prolong life. Emergency medical and hospital personnel shall honor the person's wishes, if the wrist band identification:
(1) Is being worn at the time of the provision of emergency services;
(2) Accurately indicates the person's name, date of birth, and name of the current health-care provider; and
(3) Is not defaced or mutilated.
The wrist band identification shall read:
"I, (name of person), DOB (date of birth), have executed an unrevoked advance health-care directive in which I chose to not prolong my life in the event that I become unconscious and, to a reasonable degree of medical certainty, will not regain consciousness. My current health-care provider is (name of provider or clinic)."
(b) The health-care provider indicated on the wrist band identification shall be immediately notified by emergency medical or hospital personnel of the person's medical condition resulting from the emergency; provided that authorization from the health-care provider to not prolong life shall not be required.
(c) Emergency medical and hospital personnel shall not be subject to liability or damages for honoring the person's wishes under subsection (a).
(d) If a person having a wrist band identification under this section revokes the decision not to prolong life, that person shall promptly notify the person's current health-care provider and shall surrender the band to the current health-care provider even if the current health-care provider is not the same health-care provider indicated on the wrist band identification.
(e) If the person having a wrist band identification under this section changes health-care providers, or if the wrist band identification is defaced, mutilated, or lost, the person may obtain a new wrist band identification from the person's current health-care provider upon surrender to the current health-care provider of the obsolete, defaced, or mutilated wrist band identification.
(f) Health-care providers that receive obsolete, defaced, or mutilated wrist bands returned from persons that have revoked their end-of-life decision, may destroy the wrist bands or may attach the voided wrist band to the person's medical record.
(g) For purposes of this section, "current health-care provider" means the health-care provider of the person at the time of the medical emergency."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
