A BILL FOR AN ACT

 

RELATING TO INTOXICATING LIQUOR.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 281-44, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

"(a) All licensed premises shall post a sign in or about the premises containing and notifying all customers and other persons of [the]:

(1) The possible sanctions that may be imposed for operating a vehicle under the influence of an intoxicant under sections 291E-41 and 291E-61[.];

(2) The possible effects of drinking alcohol while pregnant, including the possibility of birth defects; and

(3) The possible effects of driving a car after consuming alcoholic beverages.

The sign shall be conspicuously positioned in order to be seen by an ordinarily observant person. The sign shall read, in letters at least one-half inch high, "Consumption of alcoholic beverages impairs your ability to drive a car and may cause birth defects," and in letters at least one-quarter inch high, "Driving while legally intoxicated may result in a loss of your license, financial penalties, and/or jail time. Drinking alcoholic beverages while pregnant may be responsible for birth defects.""

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
