A BILL FOR AN ACT

 

proposing an amendment to article xvi of the constitution of the state of hawaii.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Article XVI of the Constitution of the State of Hawaii is amended by adding a new section to read as follows:

"Section 17. The membership of any retiree of the State or any political subdivision thereof in any employee health benefits system of the State or any political subdivision thereof shall be a contractual relationship, the accrued benefits of which shall not be diminished or impaired."

SECTION 2. The question to be printed on the ballot shall be as follows:

"Shall the health benefits of retired public sector employees be constitutionally protected from being diminished or impaired?"

SECTION 3. New constitutional material is underscored.

SECTION 4. This amendment shall take effect upon compliance with Article XVII, section 3, of the Constitution of the State of Hawaii.
