A BILL FOR AN ACT
PROPOSING AMENDMENTS TO ARTICLE x OF CONSTITUTION OF THE STATE OF HAWAII.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to: propose an amendment to article X, section 2, of the Constitution of the State of Hawaii, to create a state board of education comprising seven members who are elected in a non-partisan manner by qualified voters within seven school board districts, and six at-large members who are appointed by the governor with the advice and consent of the senate; and propose a new section to be added to article X to create seven regional education agencies to deliver educational services within the seven school board districts, under the governance of appointed boards of directors.
SECTION 2. Article X, section 2, of the Constitution of the State of Hawaii is amended to read as follows:
"STATE BOARD OF EDUCATION
Section 2. There shall be a state board of education composed of thirteen members. Six members shall be nominated by, and with the advice and consent of the senate, appointed by the governor, as provided by law. Seven members [who] shall be elected in a nonpartisan manner by qualified voters, as provided by law, from [two at-large school] seven school board districts. The [first school board district shall be comprised of the] island of Oahu and all other islands not specifically enumerated[. The second school board district shall be comprised of the islands of Hawaii, Maui, Lanai, Molokai, Kahoolawe, Kauai and Niihau. Each at-large school board district shall be divided into departmental school districts, as may be provided by law. There shall be at least one member residing in each departmental school district.] shall be divided into four districts. The island of Hawaii shall comprise one district, the islands of Maui, Molokai, and Lanai shall comprise one district, and the island of Kauai shall comprise one district. All elected board members shall live within the district from which they are elected.
The Hawaii State Student Council shall select a public high school student to serve as a nonvoting member on the state board of education."
SECTION 3. The question to be printed on the ballot shall be as follows:
"Shall the composition of the state board of education be changed from a board composed of all elected members to a board composed of seven elected members representing seven school districts and six members at-large to be appointed by the governor, with the advice and consent of the senate?"
SECTION 4. Article X is amended by adding a new section to be appropriately designated and to read as follows:
"REGIONAL EDUCATION AGENCIES
Section . There shall be seven regional education agencies for the delivery of educational services to all public schools, with one regional education agency per state school board electoral district and each governed by a board of directors, as provided by law. Each board of directors shall include as a voting ex officio member, the elected state board of education member from the school board district comprising the schools within the respective regional education agency."
SECTION 5. The question to be printed on the ballot shall be as follows:
"Shall there be established seven regional education agencies for the delivery of educational services to all public schools, which shall be governed by an appointed board of directors, and shall the board of directors include the elected member of the state board of education from the school board district comprising the schools within each respective regional education agency?"
SECTION 6. Constitutional material to be repealed is bracketed and stricken. New constitutional material is underscored.
SECTION 7. These amendments shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
