A BILL FOR AN ACT

 

relating to film.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 304, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§304- Film students; access to the Hawaii film studio. Notwithstanding any law or lease provisions to the contrary, students enrolled in film or film-related courses at the University of Hawaii colleges of arts and sciences, department of theater and dance, or in any other department offering film courses, may use and shall have reasonable access to the Hawaii film studio and its facilities at Diamond Head on the island of Oahu."

SECTION 2. Act 127, Session Laws of Hawaii 1997, is amended by amending subsection (a) of section 5 to read as follows:

"(a) The department of business, economic development, and tourism [is authorized to] may lease the Hawaii film studio up to the maximum term allowable by law through a general request for proposals consistent with chapter 103D, Hawaii Revised Statutes, if the director of business, economic development, and tourism determines that it would be in the best interests of the State to lease the Hawaii film studio to a private entity or entities; provided that [the]:

(1) The lease shall require that the Hawaii film studio and property upon which it is situated continue to be used as a support facility for the production of film and television productions[.]; and

(2) Upon renewal of the lease after July 1, 2003, the renewed lease terms shall require that the Hawaii film studio and property upon which it is situated may be used by students enrolled in film or film-related courses at the University of Hawaii colleges of arts and sciences, department of theater and dance, or in any other department offering film courses, who shall be given reasonable access to Hawaii film studio facilities."

SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2003.
