A BILL FOR AN ACT

 

relating to utility lines.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Notwithstanding any law to the contrary, there is established a moratorium commencing on the effective date of this Act on the construction and installation of any one hundred thirty-eight kilovolt or greater high-voltage electric transmission lines or systems. The moratorium shall:

(1) Be in force, without exception, for a period of three years from the effective date of this Act; and

(2) Apply to any project for which construction has not commenced prior to the effective date of this Act.

As used in this Act, "construction" shall not be deemed to have commenced unless at least $250,000 has been expended on actual on-site construction work. The term shall not include any amounts expended on the purchase of supplies or equipment or the transportation of supplies or equipment to the site.

SECTION 2. This Act shall take effect upon its approval.
