A BILL FOR AN ACT

 

relating to state irrigation systems.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that in 2002, the agricultural community's priority was to provide necessary resources to maintain new and existing irrigation systems statewide. Although the legislature approved capital improvement project funding for various irrigation systems, including a system for upcountry Kula, Maui, the governor vetoed that line item of the budget. The legislature finds it appropriate to reincorporate this capital improvement project into the next fiscal year's budget.

The legislature further finds that the Molokai irrigation system advisory board has determined that the Molokai irrigation system facilities require capital improvements. To maintain the system's effective and consistent delivery of water, the system needs funding to rehabilitate the existing facilities.

The purpose of this Act is to issue general obligation bonds and appropriate funds for an agricultural dual line water system in upcountry Kula, Maui, and for capital improvements on the Molokai irrigation system.

SECTION 2. The director of finance is authorized to issue general obligation bonds in the sum of $6,000,000, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2003-2004, for an agricultural dual line water system in upcountry Kula, Maui. This project is deemed necessary to qualify for federal aid financing and/or reimbursement.

The sum appropriated shall be expended by the department of agriculture for the purposes of this Act.

SECTION 3. The director of finance is authorized to issue general obligation bonds in the sum of $500,000, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2003-2004, for capital improvements on the Molokai irrigation system.

The sum appropriated shall be expended by the department of agriculture for the purposes of this Act.

SECTION 4. The appropriation made for the capital improvement projects authorized by this Act shall not lapse at the end of the fiscal year for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2005, shall lapse as of that date.

SECTION 5. This Act shall take effect on July 1, 2003.
