A BILL FOR AN ACT

 

RELATING TO SOLID WASTE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that both state and federal laws encourage the use of recycled products by government agencies as a way to encourage recycling of waste by-products and to protect our environment from the increasing volume of waste. The legislature further finds that the State's integrated solid waste management program requires county plans for the safe disposal and recycling of waste products to protect the public and the environment from exposure to hazardous waste. However, the legislature is concerned about the use of recycled waste products in areas where children most often are engaged in recreational programs, because although the recycled products may be treated according to federal and state laws, these recycled products could still contain levels of contaminants to which children may be more sensitive than adults. Thus, the legislature believes that there should be a statewide prohibition on the use of recycled products containing sewage sludge on the grounds of public school campuses, state parks, and county parks and playgrounds.

SECTION 2. Section 103D-1005, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

"(c) In addition to the requirements for the purchase of office paper and printed material under subsection (e), and when appropriate, purchase specifications shall include, but not be limited to, paper, paper products, glass and glass by-products, plastic products, mulch and soil amendments, tires, batteries, oil, paving materials and base, subbase, and pervious backfill materials[.]; provided that recycled products containing sludge from waste treatment plants or water supply treatment plants shall not be used on the grounds of public school campuses, state parks, and county parks and playgrounds. Paving materials to be considered shall include, but are not limited to, asphalt, tires, crushed concrete for base, subbase, and paving materials. The standards and specifications shall provide for the use of recycled materials and shall not reduce the quality standards for highway and road construction."

SECTION 3. Section 342G-42, Hawaii Revised Statutes, is amended to read as follows:

"§342G-42 Office responsibilities for recycled products procurement. The office, in coordination with the state procurement office, shall ensure that all state and county purchasing agencies are provided with the information and technical assistance necessary to promote the procurement of goods with recycled-content[.]; provided that recycled products containing sludge from waste treatment plants or water supply treatment plants shall not be used on the grounds of public school campuses, state parks, and county parks and playgrounds."

SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
