A BILL FOR AN ACT

 

relating to civil service law.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 76, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

"§76- Reduction of hours and pay. (a) Notwithstanding any law or collective bargaining agreement to the contrary, a public employer may unilaterally reduce the hours and pay of any non-essential employee due to lack of work, lack of funds or other legitimate reasons.

(b) For purposes of this section, "non-essential employee" means any employee whose duties are not vital to the health or safety of the public."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
