A BILL FOR AN ACT

 

proposinG an amendment to Article X, Section 3, of the Constitution of the State of Hawaii to replace the single, statewide superintendent of education with a superintendent of education for each departmental school district established by law.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to propose an amendment to Article X, Section 3, of the Constitution of the State of Hawaii to replace the single, statewide superintendent of education with a superintendent of education for each departmental school district established by law.

This Act is intended to strike a balance between the desire for local control and the need for consistent direction. By retaining the single, statewide board of education, this Act ensures there will be consistent direction on policy matters affecting the entire State. Conversely, by replacing the single, statewide superintendent of education with a superintendent of education for each departmental school district established by law, this Act ensures there will be local control over operational matters limited in scope to an island or specific areas of an island.

SECTION 2. Article X, section 3, of the Constitution of the State of Hawaii is amended to read as follows:

"[POWER] POWERS OF THE BOARD OF EDUCATION

Section 3. The board of education shall have the power, as provided by law, to formulate statewide educational policy, and shall appoint [the] a superintendent of education as the chief executive officer [of the public school system.] for each departmental school district established by law."

SECTION 3. The question to be printed on the ballot shall be as follows:

"Shall the single, statewide superintendent of education be replaced with a superintendent of education for each departmental school district established by law?"

SECTION 4. Constitutional material to be repealed is bracketed and stricken. New constitutional material is underscored.

SECTION 5. This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
