A BILL FOR AN ACT

 

RELATING TO THE MANAGEMENT OF DEPARTMENT OF EDUCATION FACILITIES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

PART I

SECTION 1. The purpose of this part is to:

(1) Establish the school support division and the general support division within the department of accounting and general services;

(2) Transfer all school-related functions within the central services division and the public works division of the department of accounting and general services to the school support division; and

(3) Consolidate the remaining functions of the central services division and the public works division within the general support division,

effective January 1, 2004.

SECTION 2. (a) Effective January 1, 2004, there is established within the department of accounting and general services, the school support division and the general support division.

(b) The comptroller shall:

(1) Transfer all school-related functions within the central services division and the public works division of the department of accounting and general services to the school support division; and

(2) Consolidate the remaining functions of the central services division and the public works division within the general support division,

effective January 1, 2004.

(c) All officers and employees whose functions are transferred by this part shall be transferred with their functions and shall continue to perform their regular duties upon their transfer, subject to the state personnel laws and this part.

No officer or employee of the State having tenure shall suffer any loss of salary, seniority, prior service credit, vacation, sick leave, or other employee benefit or privilege as a consequence of this part, and such officer or employee may be transferred or appointed to a civil service position without the necessity of examination; provided that the officer or employee possesses the minimum qualifications for the position to which transferred or appointed; and provided that subsequent changes in status may be made pursuant to applicable civil service and compensation laws.

An officer or employee of the State who does not have tenure and who may be transferred or appointed to a civil service position as a consequence of this part shall become a civil service employee without the loss of salary, seniority, prior service credit, vacation, sick leave, or other employee benefits or privileges and without the necessity of examination; provided that such officer or employee possesses the minimum qualifications for the position to which transferred or appointed.

If an office or position held by an officer or employee having tenure is abolished, the officer or employee shall not thereby be separated from public employment, but shall remain in the employment of the State with the same pay and classification and shall be transferred to some other office or position for which the officer or employee is eligible under the personnel laws of the State as determined by the comptroller or the governor.

PART II

SECTION 3. The department of education and the department of accounting and general services shall conduct analyses and a feasibility study to determine if further consolidation of facilities management functions would result in a more efficient and effective organization to support educational services. The superintendent of education and the comptroller shall submit their findings and recommendations to the legislature not less than twenty days prior to the convening of the regular session of 2004. The superintendent and the comptroller may submit separate dissenting reports, if they are unable or unwilling to reach agreement on the aforementioned findings and recommendations.

Part III

SECTION 4. This Act shall take effect upon its approval.
