A BILL FOR AN ACT

 

RELATING TO HAWAIIAN AFFAIRS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Senate Concurrent Resolution No. 106, S.D. 1, Regular Session of 1989 (S.C.R. 106), requested the governor to appoint a task force for Hawaiian services. The task force was composed of eighteen public and private sector groups, which adopted the name "Hui 'Imi task force for Hawaiian services" (task force). The defined purpose of the task force was to make findings and recommendations concerning the coordination of public and private services available to Hawaiians in the areas of education, economic development, housing, employment, medicine, law, cultural issues, and social service issues.

The task force produced a two-volume report entitled, "The Hui 'Imi Task Force for Hawaiian Services" in accordance with S.C.R. 106. The report contained findings and thirty-nine recommendations. After presentation of the report to the legislature, the task force ceased.

Since the task force report, the members remained active in working together informally to address a variety of issues relating to the delivery of social services to native Hawaiians. Act 376, Session Laws of Hawaii 1997 (Act 376), denominated the task force the Hui 'Imi advisory council and established it into law. However, Act 376 did not make an appropriation to fund its activities.

The legislature finds that the work of the task force remains a valuable resource to the State and the native Hawaiian community by serving as a forum in which ideas and concerns relating to human service issues that are important to Hawaiians may be expressed and shared among the public and private agencies involved in the delivery of those services to the native Hawaiian community.

The legislature further finds that the Hui 'Imi advisory council should be transferred from department of accounting and general services to the office of Hawaiian affairs.

The purpose of this Act is improve the effectiveness and utility of the Hui 'Imi advisory council and to make an appropriation for the advisory council's activities.

SECTION 2. Act 376, Session Laws of Hawaii 1997, is amended by amending section 2 to read as follows:

"SECTION 2. There is established a Hui 'Imi advisory council, to be placed within the [department of accounting and general services] office of Hawaiian affairs for administrative purposes only. The advisory council may consist of representatives from the following:

(1) Office of Hawaiian affairs;

(2) Department of education;

(3) Department of Hawaiian home lands;

(4) Department of health;

(5) Department of human services;

(6) House of representatives standing committee with primary jurisdiction over Hawaiian affairs;

(7) Senate standing committee with primary jurisdiction over Hawaiian affairs;

(8) ALU LIKE Inc.;

(9) The Association of Hawaiian Civic Clubs;

(10) E Ola Mau;

(11) The Kamehameha Schools [Bishop Estate];

(12) The Lunalilo home;

(13) The Native Hawaiian Culture and Arts Program of the Bernice Pauahi Bishop Museum;

(14) The Native Hawaiian Legal Corporation;

(15) Papa Ola Lokahi;

(16) The Queen Lili'uokalani Children's Center; [and]

(17) Department of business, economic development, and tourism;

(18) Department of land and natural resources;

(19) University of Hawaii; and

[(17)] (20) Any other agency, organization, or entity that expresses interest in participating in fulfilling the advisory council's mandate.

The advisory council shall make a good faith effort to include as members other public and private agencies, organizations, or entities that express interest in fulfilling the advisory council's mandate.

Each member shall be appointed by the director or other chief executive of the respective organization within forty-five days following the effective date of this Act. The members shall select a chairperson and establish procedural rules[.] for its internal administration. Such rules shall be exempt from chapter 91. Administrative expenses of the advisory council, such as photocopying, postage, stationary, and office supplies incidental to the performance of members' duties may be reimbursed out of appropriations made from time to time by the legislature and the office of Hawaiian affairs, but [Members] members shall otherwise serve without compensation and without reimbursement for [expenses, including] travel expenses[, necessary for the performance of their duties].

The advisory council shall[:

(1) Advise the governor, the legislature, and public and private agencies serving Hawaiians on issues described in the Hui 'Imi task force volumes I and II; and

(2) Serve] serve as a liaison between public and private entities serving the Hawaiian community in the planning and development of collaborative public and private endeavors."

SECTION 3. Act 376, Session Laws of Hawaii 1997, is amended by amending section 3 to read as follows:

"SECTION 3. The Hui 'Imi advisory council shall:

(1) Submit a report of its findings and recommendations, including an action plan for the implementation of Hui 'Imi task force report volumes I and II, to the governor and the legislature no later than twenty days prior to the convening of the regular session of 1998;

(2) Submit annual progress reports regarding the action plan, including legislative recommendations no later than twenty days prior to the convening of the regular sessions of 1999, 2000, 2001, 2002, 2003, 2004, and 2005; [and

(3) Cease to exist on June 30, 2004.]

(3) Investigate issues described in the Hui 'Imi task force report volumes I and II, and on such other issues affecting Hawaiians as the advisory council shall designate; and

(4) Submit a report of its findings and recommendations, including an action plan for the implementation of the Hui 'Imi task force report volumes I and II with a view toward incorporating the action plan into the Hawaii state planning Act under chapter 226, Hawaii Revised Statutes. An interim report regarding the requirements of this paragraph shall be submitted to the governor and legislature not later than twenty days prior to the convening of the 2004 regular session, and a final report shall be submitted to the governor and the legislature no later than twenty days prior to the convening of the regular session of 2005."

SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $10,800, or so much thereof as may be necessary for fiscal year 2003-2004, and the sum of $13,000, or so much thereof as may be necessary for fiscal hear 2004-2005, for the purposes of this Act; provided that no funds shall be made available under this Act unless the office of Hawaiian affairs provides matching funds.

SECTION 5. The sum appropriated shall be expended by the office of Hawaiian affairs for the purposes of this Act.

SECTION 6. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 7. This Act shall take effect upon its approval; provided that section 4 shall take effect on July 1, 2003.
