A BILL FOR AN ACT

 

RELATING TO PUBLIC EMPLOYMENT.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the employment of individuals on a temporary basis is sometimes necessary to ensure continued delivery of government services to the public. However, this practice can result in personnel cost and management inefficiencies.

Act 253, Session Laws of Hawaii 2000, was enacted with the intent to, among other things, reform and modernize public employment laws to improve the efficiency and effectiveness of government. The general practice of hiring personnel outside of the civil service system was narrowed in favor of encouraging hiring through the civil service system and in accordance with merit principles.

However, the legislature finds that existing law does provide an opportunity for the employment of temporary employees for terms that are longer than necessary. In some cases, an individual is hired for numerous consecutive short terms to avoid hiring through the civil service system. The legislature finds that this practice contributes to government inefficiency and stifles the development of the State's workforce.

The purpose of this Act is establish a clear and absolute limitation on the employment of individuals on a temporary basis by restricting their maximum term of employment to one-hundred eighty consecutive days and deeming the individual ineligible for employment during the two years following the reemployment.

SECTION 2. Chapter 76, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§76-    Employment for positions with a limitation date, generally. Any individual may be employed in a position with a limitation date exempted from civil service recruitment procedures pursuant to section 76-16(d); provided that:

(1) The term of employment, including any authorized extensions, shall not exceed one hundred eighty consecutive days; and

(2) The employee shall not be eligible for another employment term under this section during the two years immediately following the last day of the employment."

SECTION 3. New statutory material is underscored. SECTION 4. This Act shall take effect upon its approval.
