A BILL FOR AN ACT

 

relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to allow stipends for tutors and other volunteers who help schools before, during, and after school hours.

SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§302A-   Tutors and other volunteers who help schools; stipends. Public schools may pay stipends for tutors and other volunteers who help schools before, during, and after school hours, provided that:

(1) Such stipends shall not be income for the purposes of determining the tutor's or other volunteer's individual income tax for the State of Hawaii; and

(2) These individuals shall not be considered employees of the State of Hawaii."

SECTION 3. New statutory material is underscored. SECTION 4. This Act shall take effect on July 1, 2004.
