A BILL FOR AN ACT
RELATING TO ZONING
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§46- Campaign headquarters; permitted use in residential areas. (a) For purposes of section 46-4, a campaign headquarters of a candidate shall be considered a residential use of property and shall be a permitted use in residentially designated zones, including but not limited to zones for single-family dwellings; provided that the campaign headquarters is the primary residence of the candidate. No conditional use, permit, variance, or special exception shall be required for a residence also used as a campaign headquarters.
(b) This section shall not be construed as prohibiting a candidate from maintaining a post office box as an additional mailing address for receiving a contribution.
(c) For purposes of this section:
"Candidate" has the same meaning as in section 11-191.
"Campaign headquarters" means the dwelling unit that also serves as the mailing address and telephone number of the committee as contained in the organizational report under section 11-196 of the candidate's committee.
"Contribution" has the same meaning as in section 11-191."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
