A BILL FOR AN ACT

 

Making an appropriation to determine and implement the best mitigation measure to control flooding of lake wilson.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that severe storms cause massive volumes of water to flow into Lake Wilson in a short period of time and causes flooding of the surrounding area. The floods cause significant harm and damage to the residents living downstream of Lake Wilson. It is in the best interests of the State to determine and construct an effective means to mitigate or prevent any damage to property or loss of life that may be caused by the flooding.

The purpose of this Act is to conduct a study to determine the best mitigation measure to control peak flows entering Lake Wilson from storms to a level that can be safely and economically carried downstream by the drainage system, and to implement the planning, design, and construction of the measure.

SECTION 2. The department of land and natural resources shall conduct a study of the flooding problems caused by peak flows into Lake Wilson from storms. The department shall examine alternatives and determine the best means to prevent flooding to residents living downstream from Lake Wilson by controlling peak flows from storms to a level that can be safely and economically carried downstream by the drainage system. The alternatives examined shall include the storing of part of the flood flow for a period of time to reduce the downstream peak flow of water and mitigation of flood damage. The study shall also determine an effective means to lessen the impact of urbanization on downstream waterways and to mitigate other existing flooding problems. The department shall further determine the costs for implementing the best mitigation measure of the study, and plan, design, and construct the improvements required to implement the measure.

SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2004-2005, for the department of land and natural resources to conduct a study of the flooding problems caused by peak flows into Lake Wilson from storms.

SECTION 4. The director of finance is authorized to issue general obligation bonds in the sum of $          , or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2004-2005, for the purpose of planning, designing, and constructing the improvements required to implement the measure determined by the department of land and natural resources to be best suited to mitigate the flooding issues examined in the study mandated by this Act.

SECTION 5. The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

SECTION 6. The appropriation made for the capital improvement project authorized by section 4 of this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2006, shall lapse as of that date.

SECTION 7. This Act shall take effect on July 1, 2004.
