A BILL FOR AN ACT

 

relating to education.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 304, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§304-   Candidate advisory council for the board of regents of the University of Hawaii. (a) There is established a candidate advisory council for the board of regents of the University of Hawaii to assist the governor in determining criteria for, and identifying and recruiting qualified candidates for, membership on the board. The council shall be attached to the office of the auditor for administrative purposes.

(b) The advisory council shall consist of twelve members, provided that:

(1) Four members shall be appointed by the president of the senate;

(2) Four members shall be appointed by the speaker of the house of representatives; and

(3) Four members shall be appointed by the governor;

provided that one member shall be an undergraduate student of the University of Hawaii and one member shall be a graduate student of the University of Hawaii. No more than one-third of the members appointed by each appointing authority may be current or former legislators. No more than half of the members appointed by each appointing authority may belong to the same political party; provided that political activity or affiliation is not required for the appointment of any member. Statewide representation shall be taken into consideration when making appointments, and at least one member appointed by each appointing authority shall be a resident of a county other than Honolulu. The members shall serve six year terms; provided that for the initial appointments, one person from each appointing authority shall be appointed for a one year term, one for a two year term, one for a three year term, one for a four year term, one for a five year term, and one for a six year term. A member may be appointed for more than one term.

(c) The advisory council shall:

(1) Develop a statement of the selection criteria to be applied and a description of the responsibilities and duties of a member of the board and shall distribute this statement to potential candidates; and

(2) For each position on the board, identify and recruit qualified candidates for the board, based on the background and experience of the candidates, and their potential for discharging the responsibilities of a member of the board.

(d) The advisory council shall recommend at least four and not more than six candidates for each seat on the board within one month of notification of a vacancy of upcoming vacancy. The governor shall select from among the council's recommendations."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
