A BILL FOR AN ACT

 

RELATING TO the hana wharf AND SMALL BOAT HARBOR.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature recognizes that the Hana Wharf and Small Boat Harbor on Maui are important to the Hana community as public facilities and historical landmarks. Ensuring access to Hana by sea supports the local economy. It gives farmers an alternate means to transport their produce, and therefore expands potential markets to include Kahului and other Islands. Building and maintaining the infrastructure needed to access Hana by sea also creates more options for people commuting in and out of Hana for work.

Due to the remote location of Hana, there are times when the community is completely isolated from the rest of Maui. During and after severe weather, the road going in and out of Hana is sometimes shut down and impassable and airline service to Hana is suspended.

The wharf in its present condition is structurally unsound and unsafe and the small boat harbor is in serious need of repair and modification due to damage incurred during recent storms and high surf. Repairing the wharf and small boat harbor maintains critical elements of Hana's infrastructure that provide an alternate access point for the people of Hana. This alternative is especially valuable when emergency medical supplies, personnel, or transportation are required and the other modes of providing those services are not viable.

The purpose of this Act is to authorize the issuance of general obligation bonds and appropriate funds for the repair and modification of the Hana Wharf and Small Boat Harbor in Hana, Maui.

SECTION 2. The director of finance is authorized to issue general obligation bonds in the sum of $15,000,000, or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2004-2005, for the repair and modification of the Hana Wharf in Hana, Maui.

SECTION 3. The director of finance is authorized to issue general obligation bonds in the sum of $ , or so much thereof as may be necessary, and the same sum, or so much thereof as may be necessary, is appropriated for fiscal year 2004-2005, for the repair and modification of the Hana Small Boat Harbor in Hana, Maui.

SECTION 4. The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

SECTION 5. The appropriations made from the issuance of general obligation bonds authorized by this Act shall not lapse at the end of the fiscal year for which the appropriations are made; provided that all moneys from the appropriations unencumbered as of June 30, 2006, shall lapse as of that date.

SECTION 6. This Act shall take effect on July 1, 2004.
